We allow access to our site on a temporary basis and we reserve the right to withdraw, restrict or change our site at any time and without notice. We will not be liable if for any reason our site is unavailable at any time or if the content is changed or out of date.

You must treat as confidential any user identification code, password or other security feature in relation to our site. If, in our opinion, you aren’t complying with these terms of use, we have the right to disable any such code, password or feature at any time. 

You must comply with the provisions of our Acceptable Use Policy when using our site.

LICENSING OF DIGITAL PRODUCTS

Unless expressly stated otherwise at the point of purchase, all digital products purchased from our site are provided under a personal licence only. A personal licence grants a single individual the non-exclusive, non-transferable right to use the product on one (1) website owned and operated by that individual. Personal licences do not permit use by multiple people, in multiple businesses, or on multiple websites.

You must not share, sell, sub-license, loan, gift, distribute, publish, or otherwise make any of our digital products (or any modified version of them) available to any third party. You must not reproduce, copy or exploit the products for any commercial purpose, save as expressly permitted under a limited commercial licence as set out below.

Where a limited commercial licence is expressly stated at the point of purchase, this grants a single designer or design business the non-exclusive, non-transferable right to incorporate the product into one (1) website template for resale to their own clients. Under a limited commercial licence, you must significantly customise and incorporate the product into a broader design; you must not resell, share, or distribute the product “as is” or in a manner that allows it to be extracted, reused, or re-sold as a standalone item.

In all cases, all intellectual property rights in our products (including any modifications or derivative works created by you) remain owned by us or our licensors. No ownership in any intellectual property is transferred to you under these terms. Any use of our products beyond the scope of the licence granted will constitute an infringement of our intellectual property rights and may result in the immediate termination of your licence without refund, and/or further legal action.

RELIANCE ON INFORMATION AND LINKS

The contents of our site (including links to other sites and resources provided by third parties) are for information only, and we shall not be liable for any use of, or reliance on, such materials. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE

We process information about you in accordance with our Privacy Policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. 

LINKING TO OUR SITE

You may link to our home page only if you have first obtained our written consent and provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. We reserve the right to withdraw linking permission without notice. 

The website from which you are linking must comply in all respects with our Acceptable Use Policy and must be owned by you. 

You must not link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. 

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

UPLOADING MATERIAL TO OUR SITE

When you upload material to our site, or make contact with other users of our site, you must comply with our Acceptable Use Policy. If you upload material in breach of our Acceptable Use Policy and we suffer loss as a result, you will reimburse us for such loss. 

Any material you upload to our site will be considered non-confidential and non-proprietary and we have the right to use, copy, distribute and disclose it to third parties. If any third party claims that any material posted or uploaded by you to our site violates their intellectual property rights, or their right to privacy, we have the right to disclose your identity to them.
We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out in our Acceptable Use Policy.

VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our site by knowingly introducing any material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. 

By failing to comply with this provision, you would commit a criminal offence and your right to use our site will cease immediately and we will report your actions to the relevant authorities.

OUR LIABILITY

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we hereby expressly exclude:
All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it (whether by us or a third party), including, without limitation any liability for:

AFFILIATE PROGRAMME TERMS

These Affiliate Programme Terms (“Affiliate Terms”) set out the basis on which you may participate in the EverBooked Studio Affiliate Programme (“Programme”). By applying to or participating in the Programme, you agree to these Affiliate Terms, which form part of, and should be read alongside, our full Terms of Use.

If you do not agree with these Affiliate Terms, please do not register or participate in the Programme.

Eligibility and Registration

Participation in the Programme is subject to approval. We reserve the right to accept or reject any application at our sole discretion and without obligation to provide a reason. You must ensure that all information provided during registration is accurate, complete and kept up to date.

You are responsible for maintaining the confidentiality of your login credentials. We will not be liable for any unauthorised use of your affiliate account.

Affiliate Links and Promotion

Once admitted to the Programme, you will be provided with a unique affiliate link (and, where applicable, an optional discount code) for use in your promotional activities. You may promote EverBooked Studio products in any fair, legal, and honest manner that complies with:
  • these Affiliate Terms
  • our Terms of Use
  • our Acceptable Use Policy
  • UK advertising laws, including the requirement to disclose affiliate relationships clearly and prominently

You must not promote your affiliate link in any way that is misleading, aggressive, defamatory or otherwise harmful to our reputation.

Commissions

You will earn a commission on qualifying sales made through your unique affiliate link or code. Commissions are calculated as a percentage of the net sale price actually received by us, excluding VAT, refunds, chargebacks, discounts, and any payment processing fees.

Where a customer chooses a payment plan, you will earn commission on each successful instalment paid by that customer.

Commissions are not payable on:
  • your own purchases
  • cancelled, refunded or fraudulent orders
  • orders placed without your affiliate link or code correctly attributed

Attribution is determined solely by the tracking system provided through our affiliate platform. We do not accept responsibility for tracking failures, technical issues, or the deletion of browser cookies.

Cookie Period

The Programme operates with a 60-day cookie period. If a customer purchases within this period using your affiliate link or code, the sale will be attributed to you, provided the cookie remains active and no later affiliate link overrides it.

Payments

Commission payments are made on the 1st day of each calendar month, for all eligible commissions that have cleared the applicable holding period of 30 days. Payments are made via the payment method you provide in your affiliate account. You are responsible for ensuring your payment information is accurate and up to date.

We reserve the right to withhold or adjust commission payments where necessary to account for refunds, chargebacks, disputes or suspected misuse.

As an affiliate, you are responsible for reporting and paying any taxes due on the commission you receive.

Prohibited Conduct

You must not:
  • use your own affiliate link or code to make purchases for yourself
  • use paid advertising that bids on EverBooked Studio brand terms or variations of them
  • present yourself as an employee, partner, or representative of EverBooked Studio
  • make false, misleading or unsubstantiated claims about our products
  • use spam, unsolicited messages, or deceptive methods to promote your link
  • create websites, social media accounts or content that impersonates EverBooked Studio

Any prohibited conduct may result in immediate removal from the Programme and forfeiture of unpaid commissions.

Marketing Materials

We may provide optional promotional materials, product details, or key messaging to support your promotional efforts. These materials are provided “as is” and may be updated or withdrawn at any time.

You must not alter any provided materials in a way that misrepresents our brand, products or services.

Termination

We reserve the right to suspend or terminate your participation in the Programme at any time, without notice, if:
  • you breach these Affiliate Terms, our Terms of Use, or any applicable law
  • your promotional activities are, in our opinion, inappropriate or damaging
  • your account is inactive for an extended period

You may terminate your participation at any time by contacting us at support@everbookedstudio.com.

Upon termination, you must cease using your affiliate link and any related promotional materials. Any unpaid commissions accruing after the date of termination will be forfeited unless we agree otherwise at our discretion.

Liability

To the extent permitted by law, we exclude all liability for loss or damage arising from your participation in the Programme, including loss of income, anticipated profits, business, goodwill or data, whether direct or consequential.

Nothing in these Affiliate Terms limits liability that cannot legally be limited under the law of England and Wales.

Changes to the Programme

We may update or amend these Affiliate Terms, or modify or discontinue the Programme, at any time. Any changes will take effect upon publication on our website. Continued participation in the Programme constitutes acceptance of the revised terms.

JURISDICTION AND APPLICABLE LAW

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site. 

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
